Use of Copyright Materials in Educational Setting
A variety of machines, equipment, devices and programs for reproducing materials to assist staff in carrying out their educational assignments are available to staff in both the school and home setting. Staff must be aware of copyright material before reproducing any materials. Prohibited use of copyright material includes reproduction, use or distribution of copyright materials, trademarks, or other protected material without written permission from the owner. Copyright materials include:
- Literary works;
- Musical works, including any accompanying words;
- Pantomimes and choreographic works;
- Pictorial, graphic, and sculptural works;
- Motion pictures and other audiovisual works;
- Sound recordings; and
- Architectural works.
All reproduction of copyrighted material shall be conducted strictly in accordance with applicable provisions of law. "Fair use" allows for limited reproduction, use and distribution of these materials for the purpose of criticism, news reporting, teaching, scholarship and research. "Fair use" guidelines require the following:
- The purpose of the use is for educational, non-profit use including, teaching, criticism, commentary, news reporting, parody, comment, scholarship and research. Any commercial use is prohibited.
- Fact based information (information, news stories, non-fiction works) are more often fair use than imaginative and creative works. Take more care to follow additional guidelines below when using imaginative and creative works.
- The less that is used/copied, the more likely it will be fair use. Always use the smallest amount necessary and use it for the shortest amount of time possible.
- Books: May use no more than one chapter from a book (never the entire book). If more than one chapter is needed, permission must be requested from Superintendent or designee.
- Periodicals or newspapers: May use one (1) article. Copies should be limited to two thousand five hundred (2,500) words or fewer or 10% of the total work, whichever is less.
- Short story, essay or poem: May use one work per author. Copies of poems should be limited to those under two hundred fifty (250) words (or no more than two hundred fifty [250] works from a longer poem).
- Chart, graph, diagram, cartoon or picture: May use one (1) per book or article.
- Motion media: May use up to three (3) minutes or ten percent (10%) of total work, whichever is less.
- Other text materials: May use up to one thousand (1,000) words or of ten percent (10%) of total work of prose, whichever is less.
- Musical work (including video): May use thirty (30) seconds or ten percent (10%) of the total work.
- Pictorial representations: May use up to five (5) images from one (1) artist or photographer per school year. May use up to fifteen (15) images or ten percent (10%) or whichever is fewer of a collection.
- Numerical data: May use up to two thousand five hundred (2,500) fields or entries or ten percent (10%) of the total database or table, whichever is less
- Multiple copies: If making physical reproductions, may make multiple copies for classroom use, but not to exceed one (1) copy per student.
- Sheet and Recorded music: May make reproduction of sheet music to replaced purchased copies which for any reason are not available for an imminent performance, provided purchased replacement copies will be substituted in due course.
- Rule of 45: Reproduction should occur close in time to the need to use the materials and should not be used for more than forty-five (45) days. The same material should not be used for the same class school year after school year.
- Fair Use disclaimer: Each use of copyright material should include the following disclaimer:
"This reproduction contains copyright material whose use has not been specifically authorized by the copyright owner. It is being used for educational purposes only and its use in the classroom constitutes fair use. Reference for the full work is: (add full reference)"
What NOT to do:
- Do not make multiple copies of whole works as a substitute for students or school purchasing the original books, reprints or periodicals.
- Do not use more than one (1) work from a single author/creator during one (1) school year.
- Do not copy more than three (3) works from a collective work or source during one (1) school year.
- Do not copy "consumable" works, such as workbooks, exercises, tests and answer sheets.
- Do not use the same reproduced materials from school year to school year.
- Do not use the same material for more than one (1) course.
- Do not charge anyone for the reproduced materials.
- Do not use the reproduced materials for any purpose other than classroom, educational settings.
- Do not assume that because material is available for download from the internet, the fair use guidelines do not apply.
Getting Permission:
If an employee believes their use of copyright material may extend beyond the fair use guidelines above, specific permission is required by law. The employee must meet with the Superintendent or designee to obtain specific written permission for use of copyright materials. Permission must always be in writing.
Violations:
- Employees in violation of copyright law may be required to remunerate the school in the event of loss due to litigation and may be subject to discipline up to and including dismissal.

Los Lunas Schools® has two logos both of which are the property of Los Lunas Schools®. The logos are the most critical graphic identifier of the District's brand and reputation.

Los Lunas Schools® Logo(s) Guidelines
The Los Lunas Schools® logo(s) are the property of Los Lunas Schools®. The logos are the most critical graphic identifier of the District's brand and reputation. As the official logo(s) of LLS, they may not be copied or reused, but must have express written permission by the Superintendent or his/her designee.

It must appear in its official, unaltered form.

Reproduction or alteration of the LLS logo is strictly prohibited.
Approved Colors
To maintain brand consistency, the Los Lunas Schools® logo(s) color pallette is mandatory across all applications. All logo uses require strict adherence to these color guidelines. This includes print media (documents, signage, vehicle wraps), apparel (T-shirts, bags), and digital formats (presentations and electronic materials).

For the trademark "LOS LUNAS SCHOOLS®" (Bold, all-caps):
This is a bold, condensed sans-serif font to create a high-impact, professional look.
For the tagline "Every Student Matters. Every Moment Counts."
This is an italicized serif font, a very classic, flowing appearance.
